Acceptable Use Policy
In plain words. Use DimSum Takeoff and our online services for real estimating work, within the law and within the seats you pay for. Don’t break the law, don’t spread malware, don’t attack or overload our systems, don’t share sign-ins beyond your seats, don’t scrape us, don’t turn the Remote Workstation into a general-purpose tunnel, and don’t resell access unless you are an authorized reseller or partner. If you see abuse, tell us at misuse@planbaseestimating.com. If you find a security hole, follow the Vulnerability Disclosure Policy instead.
1. Who we are and what this policy covers
1.1 “Planbase”, “we” and “us” mean Planbase Estimating LLC, a Missouri limited liability company based in Kansas City, Missouri, USA.
1.2 This policy applies to everyone who uses the Services, as the Terms of Service define them, including:
- (a) the DimSum Takeoff desktop software, its updates and installers, and the DimSum 3D Viewer (“the Software”);
- (b) our websites:
planbaseestimating.com,docs.planbaseestimating.com, the customer portal atapp.planbaseestimating.com, the API atapi.planbaseestimating.comand the update service atupdates.planbaseestimating.com; - (c) DimSum Cloud, including cloud sync and cloud storage (“Cloud Storage”); and
- (d) the Remote Workstation, which lets you reach DimSum running on your own computer from a web browser, including the signalling and relay servers that carry those sessions.
1.3 This policy is part of, and is incorporated into, the Terms of Service, the End User License Agreement, the Cloud Service Terms and the Remote Workstation Addendum. Words defined in the Terms of Service (such as Workspace, Seat, Admin, Member and Customer Content) mean the same here. If this policy and one of those agreements conflict, the order of precedence in the Terms of Service (section 2.3) applies.
1.4 “You” means the person using the Services and, where that person uses them for a company, the company. A Workspace admin is responsible for making sure the Workspace’s members follow this policy.
2. Unlawful, infringing and harmful content
Do not use the Services to create, store, sync, share, transmit or display content that:
- (a) is unlawful, or that you don’t have the right to use, including plans, drawings, specifications or images that infringe someone’s copyright, trademark, trade secret or other rights. Architectural plans are often protected by copyright; only load plans you are entitled to work from (for example, plans a customer gave you for a bid);
- (b) sexually exploits or endangers children, in any form. We report such material to the National Center for Missing & Exploited Children and to law enforcement as the law requires;
- (c) threatens, harasses, defames or incites violence against any person or group;
- (d) contains other people’s personal data that you have no lawful basis to hold or share;
- (e) is classified, or is controlled under US export-control or sanctions laws (for example, technical data under the International Traffic in Arms Regulations), unless you have every authorization the law requires. Plans for military, government or critical-infrastructure sites may be restricted;
- (f) is deceptive or fraudulent, including fake estimates or reports presented as the work of someone else, or as reviewed or certified by Planbase.
We do not review Customer Content as a matter of routine. See section 11 for when we may act on it.
3. Malware and harmful files
Do not upload, sync, share, attach or transmit:
- (a) viruses, worms, ransomware, trojans, spyware, keyloggers or any other malicious code;
- (b) files built to exploit a flaw in DimSum, in a PDF reader, or in any other software, except as allowed by the Vulnerability Disclosure Policy on your own accounts and computers;
- (c) “zip bombs” or other files designed to exhaust storage, memory or processing.
4. Security and integrity of the Services
Do not, and do not help anyone else to:
- (a) access, or try to access, any account, Workspace, file, computer, server or network that you are not authorized to access;
- (b) probe, scan or test the vulnerability of the Services, except in good faith under the Vulnerability Disclosure Policy;
- (c) break, bypass, disable or interfere with any security, licensing or access control, including sign-in, license checks, the trial and its watermark, seat and machine limits, account-bound file protection, Cloud storage limits, or rate limits;
- (d) launch or take part in any denial-of-service attack, flood, or other activity that overloads or disrupts the Services or the networks they run on;
- (e) intercept, monitor, alter or replay other people’s traffic or sessions;
- (f) forge headers, impersonate Planbase, another user or anyone else, or misrepresent where traffic comes from;
- (g) use the Services in a way that harms our providers’ infrastructure (for example Cloudflare’s network) or violates their acceptable use rules as they apply to us.
5. Accounts, seats and credentials
5.1 One person per seat. Each seat is for one named person. Do not share your sign-in, password, sign-in codes, license key, license file or Remote Workstation pairing with anyone, inside or outside your company, so that more people use DimSum than you have seats for.
5.2 Reassigning seats is allowed when someone leaves or changes role, by the Workspace admin in the portal. Rotating one seat among several people to avoid buying seats is not allowed. There’s no fixed limit on reassignments, but we may ask about frequent ones.
5.3 Machines. A seat may be active on the number of computers the EULA allows (currently 2 at once). Do not clone, image or virtualize an activated machine to get around this.
5.4 Trials and the free launch offer. Do not create multiple accounts or Workspaces to get more than one Trial or more than one free launch offer for the same company (Terms section 5.4(f)), or to avoid the trial watermark. Each company gets one Trial and one free launch offer.
5.5 Automated sign-ups. Do not create accounts by script or bot, or with false identities.
5.6 Keep credentials safe. Tell us at support@planbaseestimating.com straight away if you think someone else has used your account.
6. DimSum Cloud storage
6.1 What it is for. Cloud Storage is for files you create or use with DimSum: jobs, plan sets, tool libraries, reports, settings and related project material. It is not a general file-hosting, backup, archive or content-distribution service.
6.2 Do not use Cloud Storage or sharing to:
- (a) host files for the public, or for people outside the accounts and Workspaces you share with, to download;
- (b) store material unrelated to your use of DimSum (for example media libraries or software archives);
- (c) distribute anything this policy forbids.
6.3 Storage limits are in the Subscription and Refund Policy and the Cloud Service Terms. Above the allowed limit, new uploads pause. Nothing is deleted for being over the limit.
7. The Remote Workstation
7.1 Only your own computers. Use the Remote Workstation only to reach DimSum on a computer that you own, or that your employer or client has authorized you to control. You must have the authority to install and run the Remote Workstation on that computer, and you must follow your organization’s IT and security policies.
7.2 Only for DimSum. The Remote Workstation, its signalling service and its relay servers carry DimSum sessions. Do not:
- (a) use them as a general proxy, VPN or tunnel, or to carry traffic for any other program;
- (b) extract, reuse or share the relay credentials or session tokens the Software is given, or use them outside DimSum;
- (c) stream or relay content unrelated to your DimSum work, or deliberately generate traffic to inflate usage;
- (d) share a session, pairing code or link with anyone who doesn’t hold a seat in your Workspace;
- (e) use the Remote Workstation to control a computer without the knowledge of the people responsible for it, or to watch or record anyone without their consent.
7.3 Your computer’s security. You are responsible for the computer you connect to: keep its operating system updated, lock it when unattended, and remove pairing for devices you no longer use. Details are in the Remote Workstation Addendum.
8. Scraping and automated access
8.1 Do not scrape, crawl, spider, harvest or copy the Services or their content by automated means, including the websites, the docs, the portal, the API and the update service, except:
- (a) search engines that follow our
robots.txt; - (b) link previews, feed readers using our published RSS feed, and assistive technology you use for yourself;
- (c) DimSum itself, and any interface we document for automated use, used as documented.
8.2 Do not harvest email addresses or other personal data from the Services, or collect our content to train or build machine-learning models or datasets, without our written permission. The Website Terms of Use say more about the content of our websites.
8.3 Do not call the API except through the Software or a documented interface, and do not exceed or try to evade rate limits.
9. Reselling and commercial use of access
9.1 Using DimSum for your customers is fine. Doing takeoffs and estimates for your own customers, and sending them the reports, proposals, marked-up plans and 3D view files DimSum produces, is the normal use of the Software.
9.2 Reselling access is not. Unless you are an authorized reseller or partner under a signed agreement with us (see templates/partner-agreement.md), do not:
- (a) sell, resell, rent, lease, lend, sublicense or time-share the Software, seats, license keys, Workspaces, Cloud Storage or Remote Workstation access;
- (b) run a service in which people outside your seats operate DimSum, or reach it through your Remote Workstation;
- (c) present yourself as Planbase, as a Planbase partner, or as an authorized reseller or partner when you are not. The Trademark Guidelines explain how to refer to us.
10. Messages, invitations and sharing
- (a) Send Workspace invitations and share files only to people you work with or who expect them.
- (b) Do not use invitations, sharing notices, support channels or any other part of the Services to send spam, phishing, chain letters or unsolicited advertising.
- (c) Our own emails follow the Communications Policy.
11. How we enforce this policy
11.1 Investigating. We may investigate any suspected breach of this policy. We do not routinely review Customer Content. We may look at account records, activity logs, license and machine records, and traffic metadata. We open Customer Content only where this policy, the Terms of Service or the law allows: for example, to respond to a valid legal request, a copyright notice under our Copyright and DMCA Policy, or a serious security or safety threat.
11.2 What we may do. Depending on how serious the breach is, whether it is repeated, and the risk to others, we may do one or more of the following:
- (a) contact you and ask you to stop or fix it;
- (b) remove a share, or disable access to specific content in Cloud Storage;
- (c) pause uploads, sync or Remote Workstation sessions;
- (d) revoke license keys, sessions, relay credentials or machine activations;
- (e) suspend a seat, a member or a whole Workspace;
- (f) close the account, under the termination terms of the Terms of Service and the EULA;
- (g) report the activity to law enforcement or the appropriate authority, and keep records as the law allows or requires.
11.3 Notice first, where we can. Where it is reasonable and lawful, we will tell you what we found and give you a chance to fix it before we suspend anything. We may act first, and explain afterwards, when we believe there is an immediate risk to the Services, to other users or to anyone’s safety, or when the law requires us to act or not to tell you.
11.4 Your files are not held hostage. Even when we suspend or close an account under this policy, we follow the Terms of Service on getting your own files back (Download all my data), except for content that is unlawful to return, or that we must keep or hand over by law. Files on your own computer stay there; we cannot and do not delete them.
11.5 Fees. Suspension or closure for breaching this policy does not entitle you to a refund, except where the Subscription and Refund Policy or the law says otherwise.
11.6 Disagreeing with us. If you think we got it wrong, reply to our notice or write to legal@planbaseestimating.com within 30 days. A person will review it and answer.
11.7 No duty to enforce. We are not required to monitor the Services or to enforce this policy in every case, and not acting is not a waiver.
12. Reporting abuse
12.1 Where to report.
- Abuse of the Services (spam, misuse of the Remote Workstation, credential sharing, unlawful content, impersonation): misuse@planbaseestimating.com, subject “Abuse report”. (Google Workspace doesn’t allow an abuse@ alias, so misuse@ is our abuse address.)
- Copyright infringement: follow the Copyright and DMCA Policy.
- Security vulnerabilities: follow the Vulnerability Disclosure Policy (security@planbaseestimating.com).
- Emails pretending to be from us (phishing): forward them to security@planbaseestimating.com.
- Trademark misuse: see the Trademark Guidelines.
12.2 What to include. What happened, when (with time zone), the account, email address, share link, file name or IP address involved, how you came across it, and any evidence you can send safely. Do not send us child sexual abuse material, even as evidence; describe where it is and report it to the NCMEC CyberTipline as well.
12.3 What happens next. We aim to acknowledge abuse reports within 2 business days. We may not be able to tell you what action we took, to protect the privacy of the people involved. We do not tell the reported user who reported them, unless the law requires it or you agree.
12.4 Emergencies. If someone is in immediate danger, call 911 or your local emergency number first.
13. Changes to this policy
We may update this policy as the Services change (for example, when DimSum Cloud and the Remote Workstation launch). We will post the new version with a new “Last updated” date. For a material change, we will give at least 30 days’ notice, as described in the Terms of Service.
