Trademark and Brand Guidelines
In plain words. You may use our names in plain text to say truthful things about us, like “we estimate with DimSum Takeoff” or “DimSum Takeoff training by Smith Consulting”. Don’t use our names or logos in a way that suggests we sponsor or endorse you, don’t put them in your own company, product, domain or social-media names, and don’t change our logos. Our logos are for authorized resellers, partners and the press, using the files in our brand kit. Ask legal@planbaseestimating.com for anything else.
1. Who we are and why these guidelines exist
1.1 “Planbase”, “we” and “us” mean Planbase Estimating LLC, a Missouri limited liability company based in Kansas City, Missouri, USA.
1.2 Our names and logos tell contractors and estimators that a product or service comes from us. These guidelines protect that, so people aren’t confused about who made something or who stands behind it. They apply to everyone, including customers, authorized resellers and partners, referral partners, trainers and consultants, the press and content creators.
1.3 These guidelines don’t give anyone a licence to use our marks beyond what they expressly allow. A written agreement with us (for example, a partner agreement or the referral program terms) may allow more, and wins where it differs.
2. Our marks
2.1 Word marks:
- PLANBASE ESTIMATING and PLANBASE (the company);
- DIMSUM TAKEOFF and DIMSUM (the product; “DimSum” is its short name);
- DIMSUM CLOUD (the online add-on) and DIMSUM 3D VIEWER (the free viewer).
2.2 Logos: the Planbase mark, icon and lockup (mark + PLANBASE / ESTIMATING), and the DimSum dome mark, the DimSum lockup (dome + DIMSUM + TAKEOFF) and the DimSum app icon. The files are listed in section 6.
2.3 Trade dress. The distinctive look of our websites, videos and thumbnails (the drafting-paper ground, the navy title-block bands and sheet numbers) also identifies us. Don’t copy it so closely that people could think your material is ours.
2.4 Status and symbols. None of our marks is registered yet. Until a mark is registered, we use ™, never ®. Partners must do the same, and switch to ® only when we tell them a registration has been granted.
2.5 Not our marks. File extensions such as .dsum, .tsum, .bsum and .vsum are descriptions of our file formats, not brands. Third-party names that appear in DimSum or our docs (for example Windows, or the open-source components listed in THIRD-PARTY-NOTICES) belong to their owners.
3. Getting the names right
| Write | Not |
|---|---|
| Planbase Estimating (first mention), then Planbase | PlanBase, Plan Base, Planbase Software, Planbase Inc. |
| Planbase Estimating LLC (legal contexts only) | Planbase LLC |
| DimSum Takeoff (first mention), then DimSum | Dimsum, Dim Sum, DIMSUM (in running text), DimSum Takeoff Software (as a name), DST |
| DimSum Cloud | DimSum Online, DimSum Sync |
| DimSum 3D Viewer | DimSum Viewer 3D |
- Planbase is the company; DimSum Takeoff is its product. Don’t merge them (“Planbase DimSum”, “DimSum by Planbase Takeoff”).
- Use the names as adjectives where you can (“DimSum Takeoff software”, “a DimSum job”), and don’t make them plural (“DimSums”) or turn them into verbs (“we DimSum’d the job”).
- Capitals in PLANBASE and DIMSUM belong in the logos only. In text, write Planbase and DimSum.
- Don’t abbreviate, translate, hyphenate or combine our names with other words (“DimSumPro”, “Planbase-Plus”).
4. What anyone may do (no permission needed)
You may use our word marks in plain text to refer to us and our products truthfully, as long as you use only what you need and don’t suggest a relationship that doesn’t exist. For example:
- Customers: “Estimates prepared with DimSum Takeoff”, “Our estimators use DimSum Takeoff”, or naming DimSum in a job posting (“experience with DimSum Takeoff a plus”).
- Trainers, consultants and service providers: “DimSum Takeoff training by Smith Consulting”, “We set up DimSum tool libraries for framing contractors”, with a clear statement such as: “Smith Consulting is independent and is not affiliated with or endorsed by Planbase Estimating LLC.”
- Press, reviewers and educators: articles, reviews, tutorials and course material that discuss DimSum, including fair comparisons and criticism.
- Screenshots: screenshots and screen recordings of DimSum for reviews, tutorials, training and support, as long as you don’t alter our interface to misrepresent what it does, and don’t show anyone else’s confidential plans or prices without permission.
5. What you may not do
Unless we agree in writing, don’t:
- (a) use our marks or logos in a way that suggests we sponsor, endorse, certify, partner with or are affiliated with you, your products or your estimates;
- (b) use our marks, or anything confusingly similar (for example “DimSum Estimator”, “Dimsum Pro”, “PlanBased Estimating”, or a dome logo resembling ours), in your company, product, service, app or plug-in names;
- (c) use them in domain names, social-media handles, app-store listings, email addresses or usernames (for example
dimsumtakeoff-training.comor@DimSumSupport); - (d) register any of our marks, or anything confusingly similar, as a trademark, business name, domain name or social handle, anywhere;
- (e) bid on our marks as search-advertising keywords, or use them in ad text, in a way that could confuse people about who is advertising. Authorized partners may do so only with our prior written approval, as their agreement says, and with their own name clearly shown as the advertiser;
- (f) use our logos at all, except as section 6 allows;
- (g) put our marks on merchandise (clothing, mugs, stickers) for sale or giveaway;
- (h) use our marks in a way that is false, misleading or disparaging, or in connection with unlawful activity; or
- (i) make your thumbnails, channel art or website look like ours (section 2.3), or name your channel or page so that it could be taken for our official one.
6. Logos and the brand kit
6.1 Who may use our logos:
- (a) authorized resellers and partners, as their written agreement allows;
- (b) press and media, to illustrate articles about Planbase or DimSum; and
- (c) anyone else with our written permission, from legal@planbaseestimating.com.
6.2 Use only the official files, unchanged. Our brand kit lists every logo file, the colours and the clear-space rules. We will publish it on a public brand and press page (planbaseestimating.com/brand/), with the logo files, these guidelines and a short company description, before our first partner signs; until then, ask legal@planbaseestimating.com for the files.
6.3 The rules (from the brand kit):
- Leave clear space around each logo of at least one quarter of the mark’s height.
- Use the solid Planbase icon below about 48 px wide, and the line mark and lockup above that. Use the DimSum “min” mark below about 24 px.
- Keep logos in navy
#1D2D3Don paper or white, or the light versions on that exact navy. - Don’t stretch, skew, rotate, outline, shadow, round-corner, recolour or animate the logos, or put them on photos or busy screenshots.
- Don’t rebuild the wordmarks in another font, or set PLANBASE or DIMSUM in mixed case.
- Don’t combine our lockups with each other, or with your logo, into a new logo. Show logos side by side with a divider and space between them, and keep yours at least as prominent as ours so it’s clear whose material it is.
6.4 Make the ownership clear. Wherever you use our logos or marks prominently, include: “Planbase Estimating, DimSum Takeoff and the DimSum and Planbase logos are trademarks of Planbase Estimating LLC.”
7. Authorized resellers and referral partners
7.1 Which partners this means. Businesses that simply use DimSum are customers, and section 4 covers them like anyone else. This section is about companies we authorize, in writing, to sell or refer DimSum licenses.
7.2 What authorized partners may do, under their agreement:
- (a) describe themselves as an “Authorized DimSum Takeoff Reseller” (or “Referral Partner”, as the agreement says), using the badge file we supply;
- (b) use our logos and product screenshots in their own marketing for DimSum, following section 6; and
- (c) use our word marks in product listings, quotes and invoices for DimSum licenses.
7.3 What they may not do:
- (a) use our marks in their business, trading, domain or social-media names (section 5);
- (b) suggest they are Planbase, or that they can change our prices, terms or EULA;
- (c) make claims about DimSum that we haven’t published, including features marked “Coming”, prices, availability dates, or compatibility;
- (d) use our logos in comparisons with competing products; or
- (e) send marketing email that uses our names without following the Communications Policy and the anti-spam laws that apply to them.
7.4 When the relationship ends, the partner must stop presenting itself as authorized, and remove our logos and the “Authorized” phrase from its website, materials and listings within 30 days. Ordinary truthful references (section 4) may continue.
7.5 Quality and review. We may ask to review partners’ materials that use our marks, and ask for changes.
8. Reports and documents that DimSum makes
- Reports, proposals and marked-up plans that you make with DimSum may carry your company branding (Report Branding). You don’t need to name DimSum on them.
- Don’t remove or hide the “DimSum Trial” watermark from material made during a trial (the EULA forbids it). Activate a license instead.
- Don’t add our logos to your reports in a way that suggests we prepared, checked or guarantee your estimate. We don’t.
9. Our rights
- All use of our marks is for our benefit, and any goodwill it creates belongs to us.
- We may object to any use that we believe doesn’t follow these guidelines, or that harms our marks, even if it isn’t listed above, and we may withdraw any permission.
- These guidelines aren’t a waiver of any of our rights, and don’t limit any use the law allows without permission (such as truthful descriptive or comparative use).
10. Permission, questions and reporting misuse
- To ask permission (for a logo use, co-marketing, a partner badge or merchandise): legal@planbaseestimating.com, with a description and a mock-up.
- To report misuse, such as a confusing name, a fake “official” channel, a look-alike website or a counterfeit download: legal@planbaseestimating.com. If it looks like phishing or a fake installer, also tell security@planbaseestimating.com.
11. Changes
We may update these guidelines. The current version, with its “Last updated” date, is at https://planbaseestimating.com/legal/trademarks/.
